Data breach notification

Kansas data breach notification law

Kansas places its definitions in K.S.A. 50-7a01 and its notice rules in K.S.A. 50-7a02.

Start with the misuse test

Kansas frames the duty around an investigation. If the investigation determines that misuse of information has occurred or is reasonably likely to occur, notice goes to the affected Kansas resident as soon as possible. Elsewhere the section puts the timing as the most expedient time possible and without unreasonable delay.

In practice that means a business looks at likely misuse first, and the timing rule then governs how quickly the letters go out.

What Kansas treats as personal information

A consumer's first name or first initial and last name, linked to a Social Security number, a driver's license or state identification card number, or a financial account, credit or debit card number alone or with any required security code, access code or password.

The definition applies only when those elements are neither encrypted nor redacted. So well-encrypted data falls outside the Kansas definition.

Regulators and reporting agencies

No regulator notice appears in K.S.A. 50-7a02.

Larger incidents add one more step: when more than 1,000 consumers must be told at one time, the business also notifies, without unreasonable delay, all consumer reporting agencies. That is the nationwide credit bureaus, not a state office.

Because Kansas names no state office, the planning question shifts to the people affected and, at volume, the bureaus. A business with a small incident and no likely misuse may owe no letters at all, while one with likely misuse owes them as soon as possible.

Where ShareAndGo fits

Working out what happened to a shared file starts with knowing who actually opened it.

For documents you share through ShareAndGo, the activity log records every view and download, and watermarked view-only pages carry the reader's email address and the date.

Watermarking runs per room and starts switched on, so each viewed page names the person who opened it. Invitations, uploads and changes are logged too, in a chained trail you can export as CSV. NDA acceptance before entry is available on Professional and Business.
