D.C.'s breach notice rule

The District's Consumer Security Breach Notification provisions are D.C. Code §§ 28-3851 to 28-3853, with the notice duty in § 28-3852.

Notification to residents "shall be made in the most expedient time possible and without unreasonable delay." The Code gives no fixed number of days.

When notice is not required

Acquisition of data rendered secure, including through encryption or redaction, so that it is unusable by an unauthorized third party, is excluded.

So is acquisition the business reasonably determines will likely not result in harm, but only after a reasonable investigation and consultation with the Office of the Attorney General for the District of Columbia and federal law enforcement agencies.

Our D.C. breach notification page sets out the data elements and the rule in full, and says which text we checked. This is general information, not legal advice.

What a ShareAndGo room gives a D.C. team

For documents you share through ShareAndGo, the activity log records every view and download, and watermarked view-only pages carry the reader's email address and the date.

Watermarking is on by default in every room, as a per-room setting. Recipients confirm their email with a six-digit code and need no account, and NDA acceptance is available on Professional and Business. The result is a dated record of each reader inside a shared room, exportable as CSV, which helps when the number of people involved has to be counted rather than estimated.

The courts and regulators behind D.C. paperwork
